Terms of Service

1. Acceptance of Terms

By accessing or using Elevanta, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform. These terms apply to all users including attorneys, paralegals, and administrative staff.

2. Service Description

Elevanta is a cloud-based practice management platform for immigration law firms. It includes CRM, case management, client portal, VoIP communications, automation tools, and intelligent assistant features. We provide the platform as-is, subject to the terms herein.

3. Subscription & Billing

Subscriptions are billed per user per month or annually, depending on the plan selected. The minimum user count is 1 (Starter), 3 (Professional), or 5 (Scale). You authorize us to charge your payment method on file on each billing cycle. Prices are in USD.

4. Fair Use Policy

Voice minutes and SMS included in each plan are subject to fair use. Starter: ~2,000 voice minutes/month. Professional: ~5,000 minutes/month. Scale: ~5,000 minutes/user/month. Usage significantly above these thresholds will be billed as overage at $0.05/minute (voice) and $0.03/SMS.

5. Cancellation

You may cancel your subscription at any time. Monthly subscriptions are non-refundable for the current billing period. Annual subscriptions are non-refundable after the first 30 days. Upon cancellation, your data is available for 30 days before deletion.

6. Acceptable Use

You agree to use Elevanta only for lawful purposes. You may not use the platform to harass, abuse, or harm any person; transmit spam or unauthorized communications; violate any federal or state law; or attempt to gain unauthorized access to any systems.

7. Attorney-Client Privilege & Confidentiality

Elevanta is not a law firm and does not provide legal advice. You are responsible for maintaining attorney-client privilege in all communications made through the platform. We do not review or access the content of your client communications.

8. Data Ownership

You retain full ownership of all data you input into the platform, including client records, case files, and communications. We claim no intellectual property rights over your data.

9. Limitation of Liability

To the maximum extent permitted by law, Elevanta shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising under these terms shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
